1. General

The following general terms and conditions apply exclusively to orders placed by telephone, in writing, by fax or e-mail, and to orders transmitted through our Webshop online. Our general terms and conditions apply exclusively; we do not recognize any conditions made by the purchaser which conflict or deviate from our general terms and conditions unless we have explicitly agreed in writing that such conditions apply.

2. Offer

Our offers are subject to change unless otherwise indicated in our order confirmation. The order from the purchaser is a binding offer.

We can accept this offer, at our discretion, by sending an order confirmation, or by sending the ordered product to the purchaser.

All documents associated with the order, such as drawings, illustrations, descriptions and technical details, are provided without obligation and do not constitute warranties of quality; specifically, these do not constitute any warranty on the part of the seller in regard to properties/condition or durability.

3. Prices

All pricing information is subject to change. We reserve the right to change prices due, for example, to currency fluctuations (identified by $) or price increases by our suppliers, or in order to correct errors.

List prices valid on the delivery date apply.

All prices are final prices and include the German value-added tax, currently 19%.

The German value-added tax is not computed for deliveries to commercial customers in the countries of the EU as long as we have been provided with a valid Turnover Tax – Identification Number at time the order is placed.

German value-added tax is computed for all other deliveries to EU countries.

For orders shipped to non-EU countries, the prices are reduced by the amount of the relevant value-added tax.

4. Shipping fees

All prices are quoted unpacked ex Schönau am Königssee. Shipping fees are computed at the most favorable rates based on value, weight, volume, and the nature of the product.

Where we have indicated flat-rate shipping fees, these apply only for the combined delivery and order as indicated in (1). The recipient is responsible for transportation cost and risk. Transportation insurance will be provided when explicitly requested by the purchaser. The purchaser is responsible for associated costs incurred.

5. Terms of delivery and payment

Domestic customers: If requested, delivery will be invoiced.

For payment received within 10 days, we offer a 2% discount, 30 days net.

If direct debit authorization is provided along with a bank reference, payment can be made by our debiting the designated account, as agreed in advance.

Delivery to other countries is exclusively on a cash-before-delivery or collect-on-delivery basis.

Payments by check will be charged an additional € 15.00 to cover bank fees.

Payments in advance

from other countries must be free of bank charges to the payee and made only to our above-indicated account at the Sparkasse Berchtesgaden savings bank.

For other types of payment from abroad, we must charge an additional € 15.00 to cover German bank fees.

The purchaser is entitled to setoff rights as well as other adverse rights only if his counterclaims are based on a legally enforceable judgment, are uncontested, or have been recognized by us.

The purchaser is entitled to exercise a right of retention only to the extent his counterclaim is based on the identical contractual relationship.

Complaints based on incomplete or defective delivery must be reported immediately, or within 7 days after receipt of the product at the latest.

Complaints relating to damaged shipments must be submitted immediately to the carrier (post office, UPS, TNT, forwarding agent).

You must immediately submit damage claims arising from a damaged shipment directly to the carrier.

Delivery is subject to prior sale and impossibility of performance. In the event products cannot be delivered, we retain the right to cancel the contract or to deliver products that are of equivalent quality and price. In such cases, we will notify you in a timely manner before delivery.

6. Warranty

All items are covered by a 24 month warranty valid from the date the product is shipped.

In the event an item proves defective within the warranty period, the item will be repaired according to our specification, or replaced by a new item that is identical or equivalent.

Any additional liability for damages resulting from defective or improper use is excluded. We are also not liable if the order has been placed after consulting us on the technology of the product, and the customer employs or uses the products for purposes other than that specified.

We are not liable for any damage resulting during subsequent handling of the solar modules, for example, improper treatment of the flexible solar modules during adhesive bonding; in such cases all warranty claims are voided.

7. Reservation of ownership

The delivered products remain our property until complete payment has been made, or until the equivalent amount has been credited in the case of payment by check. The delivered products may not be pledged as collateral, nor ownership thereof be transferred by way of security.

8. Storage of data

Data relating to the purchaser is saved for the purpose of processing the order. The purchaser agrees to this storage of his data by placing the order.

9. Links and cross-references

In the case of direct or indirect cross-references to other internet pages (links) which lie outside the author’s scope of responsibility, an assumption of liability would apply only to the extent the author is aware of the contents, and to the extent it would be technically feasible and reasonable for him to prevent their use where such content is illegal.

10. Jurisdiction

The place of performance and jurisdiction is Laufen. Only the laws of the Federal Republic of Germany apply.
